Explanation
CBP applied General Rule of Interpretation 1, which classifies goods by the words of the headings and notes. The letter cites the Explanatory Notes to Chapter 94, which define furniture as movable articles built to stand on the floor and used to equip offices, hospitals and similar places. CBP found the carts meet that definition.
CBP ruled the carts are mobile computer carts, usable as such in the condition they are imported, and placed them in heading 9403 as other furniture. It pointed to N212562, where CBP classified a laptop cart used in hospitals, classrooms, warehouses and other work settings in heading 9403. The line covers other metal furniture; the carts are mainly metal and plastic, with the metal frame accounting for most of the weight.
What would change the answer
- The letter notes that heading 9402 covers carts specially designed for medical instruments, bandages, medical or surgical supplies or anesthetic equipment.
Headings CBP ruled out
- heading 9402, medical, surgical, dental or veterinary furniture: Goods are classified as imported, and as imported the carts lack the features of medical carts: the drawer inserts, fetal monitor tray and wipe holder described are absent, and the scanner holder and basket suit non-medical use.
