The wand is a battery-powered toy made for imaginative play and meant principally for the amusement of children ages 3 and above. CBP said the result is consistent with its earlier ruling H026659.
The letter also notes. CBP also ruled on the wand's country of origin under the substantial transformation test, which asks whether an article comes out of processing with a new name, character or use. All of the wand's components were made in one country and went through only simple assembly (welding, screwing and gluing) in a second country, and the parts kept their separate identities, so CBP found the origin is the country where the components were made.
