Explanation
CBP treated the launcher and pom poms as a set for retail sale, as the Explanatory Notes to GRI 3(b) define one. A set is classified by the part that gives it its essential character. CBP found the plastic launcher does, by bulk, weight, value and importance to the set.
The letter cites Hartz Mountain Corporation v. the United States. That case held that plastic pet toys and supplies used by domestic household animals are household articles. CBP therefore placed the launcher, a plastic pet toy used by cats, in heading 3924 as other household articles of plastics.
Headings CBP ruled out
- Heading 9503, other toys: The requester suggested it, but Chapter 95 note 5 says heading 9503 doesn't cover articles identifiable by design, shape or material as intended only for animals, such as pet toys.
