CBP found the pouch, booklet, dye powders, rubber bands and gloves form a set for tariff purposes. The dye materials exist to decorate and personalize the pouch, and the booklet explains how. The pouch works as a useful article as imported, before and after it is decorated, so CBP found it gives the set its essential character under General Rule of Interpretation 3(b). The set is therefore classified as the pouch.
Heading 4202 covers travel, sports and similar bags, and CBP placed the pouch on the line for those bags with an outer surface of textile materials, of vegetable fibers, of cotton; the pouch's outer surface is 100 percent cotton textile.
Headings CBP ruled out
- heading 9503, toys: The kit is intended for adults, not children, and the zippered pouch has a utilitarian function of carrying small items; chapter 95 note 1(d) excludes containers of heading 4202 from toys (CBP cited H251422).
