It followed CBP Headquarters ruling HQ 958498, which classified a printed plastic bookmark on that same line after finding that a bookmark's primary purpose is marking a place in a book.
The bookmarks here are clear vinyl with printed fronts, glitter between the layers, and a charm on a chain. The letter treats the printing as incidental to that purpose.
Headings CBP ruled out
- heading 9505, party favors: Party favors are inexpensive, short-use souvenirs bought in multiples of four or more to hand out evenly at a party; a pack of three different bookmarks could be bought for one child, so the test in HQ 962454 isn't met.
- heading 4911, other printed articles: The printed design adds appeal and marketability, but marking a place in a book doesn't depend on any words or pictures, so CBP ruled the bookmarks aren't printed matter of chapter 49.
