CBP's Ruling
| Item | HTS code | CBP's description of the line |
|---|---|---|
| Card holder | HTS 3926.90.9989 | Other articles of plastics and articles of other materials of headings 3901 to 3914: Other: Other: Other |
Explanation
CBP set aside heading 4202, which lists card cases as a form of wallet, because the card holder's materials aren't among those the heading allows.
It then applied General Rule of Interpretation 3(b), the essential character rule, to the two materials, and found the rigid plastic interior gives the card holder its essential character. Treated as an article of plastic that isn't more specifically described elsewhere, the card holder falls on the residual line of heading 3926 for other articles of plastics.
Headings CBP ruled out
- heading 4202, card cases and wallets: The second half of heading 4202 covers only goods of leather, composition leather, plastic sheeting, textiles, vulcanized fiber or paperboard, or mainly covered with those or paper; metal and molded plastic aren't included.
Does this apply to your product?
It likely does if you can answer yes to each of these:
- Is it a card holder or card case?
- Is the outer shell metal rather than leather, plastic sheeting, textile or paperboard?
- Is the interior compartment made of rigid, molded plastic?
A no to any of them can mean a different code. A licensed broker can classify your product.
